Acceptance of Terms

By accessing or using the websites hosted on gamedev.in and its subdomains (collectively, the “Websites”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, you may not access or use the Websites.

Use of the Websites

You may use the Websites only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Websites in any way that violates any applicable federal, state, local, or international law or regulation.
• Engage in any conduct that could disable, overburden, or impair the Websites or interfere with any other party’s use of the Websites.
• Attempt to gain unauthorized access to the Websites, other accounts, computer systems, or networks connected to the Websites.
• Use any robot, spider, or other automatic device, process, or means to access the Websites for any purpose, including monitoring or copying any of the material on the Websites.
• Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
• Attempt to circumvent any content filtering techniques we employ, or attempt to access any service or area of the Websites that you are not authorized to access.

Intellectual Property

The Websites and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by GameDev India, its licensors, or other providers of such material and are protected by Indian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

User Content

You may be able to submit, upload, publish, or otherwise make available content on the Websites, including but not limited to text, images, video, and audio (“User Content”). You retain all of your ownership rights in your User Content, but you grant GameDev India a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media.

You represent and warrant that: (i) you own or control all rights in and to the User Content and have the right to grant the license granted above; (ii) your User Content does not and will not infringe any intellectual property or other right of any third party; and (iii) your User Content does not and will not violate these Terms or any applicable law or regulation.

Disclaimer of Warranties

The Websites are provided on an “as is” and “as available” basis. GameDev India makes no representations or warranties of any kind, express or implied, as to the operation of the Websites or the information, content, materials, or products included on the Websites. You expressly agree that your use of the Websites is at your sole risk.

Limitation of Liability

In no event shall GameDev India, its affiliates, or their respective officers, directors, employees, agents, licensors, or service providers be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Websites or these Terms, whether in an action of contract, tort (including negligence), or otherwise, even if GameDev India has been advised of the possibility of such damages.

Indemnification

You agree to indemnify, defend, and hold harmless GameDev India, its affiliates, and their respective officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or in connection with your violation of these Terms or your use of the Websites.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without giving effect to any principles of conflicts of law. You agree that any action at law or in equity arising out of or relating to these Terms shall be filed only in the courts located in Bengaluru, India, and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.

Changes to these Terms

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them.
